Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Agent37, you confirm that you are at least 18 years of age, have read and understood these Terms of Use, and agree to be bound by them. These terms apply to all users of the app, including free and subscribed users.

2. Description of Service

Agent37 is an iOS mobile application designed for real estate professionals. It provides tools for managing buyer and seller clients, tracking vendor activity, organising transaction-related files and notes, collaborating with team members, and viewing sales performance. Agent37 is available as a free download with optional paid subscription plans.

3. Account Registration

To use Agent37 you must create an account using a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately at hello@agent37.net if you suspect unauthorised access

We reserve the right to terminate accounts that violate these terms.

4. Subscription Plans and Billing

4.1 Plans

Agent37 is available on three plans:

• Free — up to 100 entries and limited storage. No charge.
• Pro — unlimited entries, 10 GB storage, team feature with up to 2 members.
• Max — unlimited entries, 50 GB storage, team feature with up to 5 members.

4.2 Pricing

Current subscription pricing:

• Pro — $11.99/month or $9.99/month billed annually ($119.90/year)
• Max — $19.99/month or $16.65/month billed annually ($199.80/year)

Prices are in US dollars and subject to change with notice.

4.3 Billing and Auto-Renewal

Subscriptions are purchased through Apple and managed via your Apple ID. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.

4.4 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of a subscription period. Upon cancellation your account reverts to the free plan and any data exceeding free limits will remain accessible but new entries and uploads will be restricted until you re-subscribe or reduce your usage.

5. Free Usage Limits

The free plan includes a maximum of 100 entries across buyers and sellers, and a storage limit for photos, receipts, and reports. When either limit is reached you will be notified and will be unable to add new entries or upload new files until you subscribe. Your existing data is never deleted as a result of reaching a free usage limit. The 100-entry limit is a lifetime, cumulative count — it does not decrease when you delete an entry, and deleting existing entries will not restore your ability to add new ones on the free plan.

6. Team Feature

Subscribed users on Pro or Max plans may invite other users to access their account as team members. By using the team feature you agree that:

• You are responsible for all activity performed by team members within your account
• Team members must also hold an active Pro or Max subscription to accept an invitation
• Your subscription plan determines the maximum number of team members permitted
• If your subscription lapses, all team member access to your account is immediately revoked
• You may remove team members at any time

7. Acceptable Use

You agree to use Agent37 only for lawful purposes and in accordance with these terms. You must not:

• Upload or share content that is illegal, harmful, defamatory, or infringes third-party rights
• Attempt to gain unauthorised access to any part of the app or its infrastructure
• Use the app to store or transmit malicious code or software
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use the app in any way that could damage, disable, or impair its functionality

8. Data and Privacy

Your use of Agent37 is also governed by our Privacy Policy. By using the app you consent to the collection and use of your data as described in that policy. You retain ownership of all client data you enter into Agent37. We do not sell your data to third parties.

9. Third-Party Services

Agent37 uses the following third-party services to operate:

• Firebase (Google) — for data storage, authentication, and push notifications
• Apple StoreKit — for payment processing
• Hostinger — for transactional email delivery
• Zippopotam.us — for zip code lookup in buyer search criteria

Your use of Agent37 is subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of these providers.

10. Transaction Links

Agent37 allows users to save links to third-party platforms such as Skyslope, Glide, Dotloop, and others. These links open external websites or applications. Agent37 is not affiliated with, endorsed by, or responsible for the content, availability, or practices of any linked third-party platform. Use of those platforms is subject to their own terms and conditions.

11. Intellectual Property

Agent37 and all its content, features, and functionality — including but not limited to the app design, logo, text, graphics, and code — are owned by Agent37 and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the app without express written permission.

12. Apple App Store Terms

Because Agent37 is distributed through the Apple App Store, the following additional terms apply and take precedence over any conflicting terms in this Agreement, but only to the extent of the conflict:

• This Agreement is between you and Agent37 only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support services for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if any; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
• Apple is not responsible for addressing any claims by you or any third party relating to the app, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the app.
• Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of this Agreement.

13. Disclaimers

Agent37 is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

• The app will be uninterrupted, error-free, or secure
• Any data stored in the app will be free from loss or corruption
• The app will meet your specific professional or legal requirements

Agent37 is a client management tool and is not a substitute for professional legal, financial, or real estate advice.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Agent37 and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including but not limited to loss of data, loss of business, or loss of revenue. Without limiting the foregoing, Agent37 and its operators are not responsible or liable for any loss, corruption, or deletion of data — including client records, notes, todos, photos, receipts, reports, or files — however caused, including as a result of device failure, connectivity issues, third-party service outages (including Firebase or Apple), account deletion, or user error. You are solely responsible for maintaining independent backups of any data that is critical to your business. Our total liability to you for any claim arising from these terms or your use of the app shall not exceed the amount you paid for your subscription in the three months preceding the claim.

15. Account Deletion

You may delete your account at any time from within the app. Upon deletion all your data — including client records, notes, todos, photos, reports, and files — will be permanently removed from our systems. This action is irreversible. Deleting your account does not automatically cancel your App Store subscription; you must cancel your subscription separately through your Apple ID settings.

16. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will update the "Last updated" date at the top of this document and notify users through the app or by email. Your continued use of Agent37 after changes take effect constitutes acceptance of the revised terms.

17. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of Agent37 shall be resolved in the courts of competent jurisdiction.
